🌍講師簡歷：

Professor Katsuya Tamai, born in Osaka 1961, is a research professor at the Research Center for Advanced Science and Technology (RCAST) of the University of Tokyo since May 1997. He started his academic career in 1983 as an assistant professor (administrative law) at the University of Tokyo Faculty of Law, becoming a lecturer at Gakushuin University Faculty of Law in 1986 and an associate professor there in 1988. In 1990, he was invited to the University of Tokyo, Faculty of Law, to be appointed Associate Professor, and in 1995, he moved within the University of Tokyo to take the position of Associate Professor at the Research Center for Advanced Science and Technology, where he officially changed his major to Intellectual Property Law. He was a visiting scholar at the Max Planck Institute for Intellectual Property Law (Munich, Germany) from 1989 to 1992 and a visiting scholar at George Washington University and the U.S. Court of Appeals for the Federal Circuit (Washington D.C.) from 1999 to 2000. Professor Tamai has been serving as the Chairman of the Subcommittee on Patent System of the Industrial Structure Council under the Minister of Economy, Trade and Industry (METI), the government committee for the improvement of the Patent Act.

🌍專業領域：

主要な研究領域は、（1）法律学の一部としての知的財産法、（2）知的財産をめぐる立法政策、および（3）産学連携・技術移転である。

（1）については、知的財産権の消尽、ブランドの価値、損害賠償額の算定方法、標準化と特許権、知的財産権と独禁法、ネットワーク上の知的財産への法適用などが、現在の研究課題である。

（2）については、デジタル・コンテンツの創出と流通の促進、職務発明制度の抜本的改革、生命倫理と特許制度、知財司法の機能の円滑化などについて、国際的な議論を視野に入れつつ、研究を進めている。

また（3）については、国内や海外のさまざまな地域でフィールド・ワークに基づく基礎研究を行っており、知識基盤型地域振興政策については内外の各地域の比較を進めている。

Patent Infringement across the Border -Potential Amendment Items of Japanese Patent Act-

🌍講題大綱：

In the patent law governs the territoriality principle, meaning that the patent rights of each country are mutually independent and enforceable only within each country. However, for example, (1) if a product manufactured in country A is realizing a patented invention of country B, the product is manufactured with the intention of exporting to country B and is actually exported to the country B, it might be considerable in some cases that the act of manufacturing in country A infringes the patent right in country B; (2) If the patented invention patented in country A is a system (a form of "product" in Japan), and although some of its components are located in country B, most of its components are located in country A, and the economic benefit is realized in country A, it is also considerable to regard it an infringement of the patent right of country A. In Japan, such issues are being contested at courts, and there are arguments that the Patent Act should be amended to deal with them clearly. The reporter would like to introduce these issues to and discuss them with the participants.
